A BILL to amend article ten, chapter eighteen-b of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section one-a, relating to providing limited residency status for military and civilian personnel and their dependents assigned to an active duty station in this state for higher education tuition purposes.

Be it enacted by the Legislature of West Virginia:
That article ten, chapter eighteen-b of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section one-a, to read as follows:
ARTICLE 10. FEES AND OTHER MONEY COLLECTED AT STATE INSTITUTIONS OF HIGHER EDUCATION.
§18B-10-1a. Limited residency status for military and civilian personnel and their dependents.
(a) The term "resident" or "residency," or any other term or expression used to designate a West Virginia resident student, when used to determine the rate of tuition to be charged students attending community colleges and state-related and state-owned institutions of higher education shall be construed to mean and include: (1) Any military personnel, and their dependents, who are assigned to an active duty station in West Virginia and who reside in this state; and (2) any civilian personnel, and their dependents, employed at a department of defense facility who are transferred to West Virginia by the department of defense and who reside in West Virginia.
(b) Military and civilian personnel and their dependents who are admitted to a community college or a state-related or state- owned institution of higher education shall be charged resident tuition rates provided that the student is a resident, as that term is defined in subsection (a) of this section, under this section on the first day of the semester or term of the college or institution.
(c) The provisions of this section apply for the semester or term immediately following the effective date of thise section.


NOTE: The purpose of this bill is to require state colleges and universities to apply in-state tuition rates to military personnel stationed in West Virginia.
